There is an interesting part of this question. This said "that suggests", so you can belive but not sure. Its only a suggestion. But, if you are an ethical, you definitely should contact the legal authorities.

No. The ethics and the law owerwrite the NDA. And the other hand, informing the proper legal authorities should be release you from the NDA , because you are possible witness of somekind of crime.
