Besides that you need to migrate from FRS to DFSR to promote 2022 server to DC, you cannot raise domain or forest functional level to 2016 unless, at minimum, all your domain controllers are on 2016 OS https://learn.microsoft.com/en-us/windows-server/identity/ad-ds/active-directory-functional-levels#windows-server-2016-functional-levels

100% No The functional level of the forest is Windows Server 2012 R2. You can add an windows 2022 DC to a forest running windows 2012R2. https://learn.microsoft.com/en-us/windows-server/identity/ad-ds/active-directory-functional-levels You cant add it when ur running FRS tho
