Agreed.
I find it always tricky to decide which requirement is a constraint and which not.
At the VMware course I've been taught that a Requirement is something not yet existing or implemented, while a Constraint is something that already exists and can't be changed.
Therefore, Existing CM guidelines falls into the Constraints, while App licensing is required but not yet defined (although it does introduce a constraint, but that can be worked around, while you can't escape the already existing CM guidelines)
